Definitions

1.1 “The Company” means Circo Consulting Limited.

1.2 “The Claimant” means the person who accepts a quotation of the company for the supply of services, or whose request for The Company to supply such services to the Claimant is accepted by The Company.

1.3 “Services” refers to accompanying mandate letter and pre-contractual information authorising Circo Consulting to act on behalf of The Claimant.

1.4 “Conditions” means the standard terms and conditions of supply set out in this document and shall also include any terms and conditions agreed in writing between The Claimant and The Company and upon acceptance thereof as specified herein shall represent the contract between The Claimant and The Company.

1.5 Any written or verbal quotation of The Company which is accepted by The Claimant or any written or verbal request of The Claimant for services which is accepted by The Company will be subject to these terms and conditions and will form the basis of the contract between The Claimant and The Company. This contract will be to the exclusion of any purported contract either written or verbal made by The Claimant.

1.6 No waiver by The Company or breach by The Claimant shall be a waiver or breach of any other provision.


Acceptance

2.1 Upon signature, the claimant is deemed to have accepted these terms and conditions.


Our Service

3.1 All services will be provided by us, Circo Consulting Ltd as the Claims Management Company.

3.2 We will require and request all relevant documentation from you in order to process a claim for you with the Redundancy Payment Service (RPS). The likely documentation required to pursue the claim is as follows: proof of identification, employment evidence such as contract, payslips and P60.

3.3 Based upon the information you provide to us and information provided by your previous employer, we will take reasonable steps to make an assessment on what entitlements you may be able to claim from the Govt National Insurance Fund, administered for these purposes by the Redundancy Payments Service (RPS). These can include – Redundancy Payments, Arrears of Pay, Unused Holiday Pay and Notice Pay.

3.4 We will prepare and submit your claim to the RPS for entitlements applicable from the Employment Rights Act 1996.

3.5 We will liaise with the RPS and the appointed Insolvency Practitioner to manage your claim.

3.6 Official guidance for processing of claims is 6 weeks, in most cases claims are processed in 3-4 weeks. Circo Consulting shall provide updates as is reasonable and will respond promptly to any queries.

3.7 Where a claim is successful, compensation will be paid to you. You will receive an itemised bill. The itemised bill will explain what claims management services have been provided and how the fees have been calculated, further describing the total amount recovered for the claimant which serves as a comparable reference for the calculation.

3.8 Accompanying payment, you will also receive the notification received by us from the RPS. This fully outlines all payments made.


Customer Claim Steps

4.1 Provide Circo Consulting Ltd with full and accurate information and not mislead the firm in any way.

4.2 Complete all requests for information, including all pre-contractual information provided with this Terms of Business.

4.3 Read and retain all claims documentation provided by our firm in consideration of the claim and service provided

4.4 Provide all documents in your possession that are relevant to the claim and where requested and which provide evidence in support of a claim.

4.5 Advise Circo Consulting Ltd regarding any change of personal contact information and without undue delay

4.6 Inform Circo Consulting Ltd of any correspondence received by you from the RPS in relation to the claim wherever received

4.7 Provide accurate bank account information upon request, Circo Consulting Ltd will not be liable if incorrect details are provided

 

Cancellations and Terminations

5.1 You may cancel this agreement within a 14 day cooling off period. Cancellations should be made in writing by email or post. Cancellations made after a 14 day period will be subject to a reasonable administration charge of £100 per hour for time spent till the cancellation date. Cancellations made after award notification by Redundancy Payment Service will be subject to the service fee below.


Pre Contractual Information

6.1 You confirm that you have received and completed all relevant pre-contractual documentation.


Using a Claims Management Company 

7.1 You are not required to use the services of a firm that carries on regulated claims management activity to pursue your claim, it is possible to present the claim to the Redundancy Payment Service (RPS) of own volition with no charge.


Fees Payable

8.1  The Fee payable to The Company will be based upon a 10% commission of Net monies you receive from the Redundancy Payment Service. If a claim is not successful, no charge will apply. No VAT applicable. For example, if you were awarded £2500, our fee (20%) will be £250.

*This fee illustration is not to be taken as an estimate of the amount likely to be recovered. This is for illustrative purposes only. The fee that you may have to pay may be more or less than the above illustration and estimate.


Outstanding Liabilities 

9.1 If you have outstanding liabilities to the employer in liquidation against whom the claim is to be made, any settlement monies might, in certain circumstances, be offset against those liabilities. If this is the case, you will be required, where necessary, to pay a fixed fee to Circo Consulting Ltd to be arranged in separate agreement.


Personal Insolvency 

10.1 If have been declared bankrupt or have been subject to a bankruptcy petition, subject to an Individual Voluntary Arrangement (IVA) or have been proposed as being subject to an IVA whether approved or not, are subject to a Debt Relief Order or any other similar process or arrangement of the kind described, whether within England, Wales, N. Ireland or Scotland, then any compensation, damages or settlement monies may, in certain circumstances, be off-set against outstanding debts and that you will be required, where necessary to pay our fees from your own funds which are not subject to the aforementioned processes e.g. an IVA.


Data and Information Sharing

11.1 In order to process your claim, Circo Consulting will share your personal information with the Redundancy Payments Service, Insolvency Practitioner associated with your case and where applicable representatives of your previous employer such as Director or the nominated accountancy firm. Your details will not be shared with any other 3rd party without additional consent.

11.2 The personal information we hold can include details such as name, address, contact details, date of birth, pay records & employment history. All data is stored securely and used solely for purposes outlined in the service proposal.

11.3 For audit purposes your data will be held for a 2-year period.


Provision of Information

13.1 By entering into an agreement with Circo Consulting, you agree that the information you provide is accurate to the best of your knowledge.

13.2 Circo Consulting will not be held responsible in the event that inaccurate information is provided. This also includes bank account information which we will obtain from you in a secure manner.
